I have just been going through some papaerwork and found my original contract to the agency I was using as a contractor up until January 2011. In that contract it stated that I was entitled to 3 weeks holiday pay from them. I was informed by my colleagues at the client that I was not entitled to holiday pay as I as a contractor. I worked through a limited company with this contract for 12 years. Would I be entitled to claim the holiday entitlement that I never did from the agency for the 12 years I was within the contract?Question posted on 06-02-2012 13:28

I bought a Nissan x trail 4x4 from a Nissan dealership 21 months ago for the purpose of towing a horse trailer and for getting to the horses in adverse weather (56 plate). I entered a hired purchase agreement with Black Horse to complete the purchase. The car sales man assured us the car was suitable for towing up to 2000kg which is approximately the weight of a trailer + horses + kit. We were considering other cars but got persuaded that this was the best option to suit our needs. Since then the vehicle has required 2 new clutches and most recently front and rear differentials have failed. the car has been at the garage for the previous 9 weeks having these repairs carried out. During this time I have not had a suitable vehicle to care for my horses, my daughter and I have missed out on many events and most recently we have not been able to get to them in the poor weather conditions as we require a 4x4 for this. Black horse has returned 2 of the monthly payments for this but this has not covered the cost of hiring a like for like vehicle. Some of the repairs have been carried out under warranty but we have had to contribute to the clutches as this was seen as wear and tear. We have been in discussion with Black Horse Finance and have complained we are not satisfied with the car. They have carried out an independent inspection that has concluded that the car is not suitable for the purpose we have been using it for. Black Horse have offered to release us from the HP agreement, they will keep the vehicle and give us £754 refund (inclusive of £470 deposit). To date I have paid £6237 + £500 towards the clutch. I would appreciate advice on whether you think this is a reasonable offer and if not what should I accept. Black Horse are putting increasing pressure on me to accept this offer. I have received a Summons from the CSA to attend a magistrates Court. I have never had any dealings with the CSA and have provided for my child, which can be verified by my ex partner. I understand that a magistrates court cannot challenge the amount claimed by the CSA, which leads me to believe that this is a rubber stamping exercise. Also the "summons" fails to state the name of the JP or magistrate who took the complaint, or the date. So I have a couple of questions; Is the summons defective? What redress do I have to have this case heard in a court where the evidence can be challenged and finally do I have the right to insist that the case be moved to a court nearer to where I live..?Question posted on 30-01-2012 13:31
I am the parent if two children and my ex partner has them to stay on weekends. I was at my ex's house and we had a disagreement I went to leave with my youngest child who at the time was un well, he took her off me and said she's not going call the police and wouldn't let me tak her home. He pushed me out of the way and wouldnt let me take her a huge scene was caused and was physical on both parts. My issue is can he stop me taking her home, do I have the right to demand taking if I feel there is good cause. Can me and my girlfriend marry without a licence granted by the government? We want to exchange vows and a private contract between the two of us. If we do this and do not get a certificate can she still use the title Mrs and change her name by deed pole? On my new contract for this year (i'm a one man limited company)it reads
" xxxxx will offer a maximum guarantee contract of 150 days work to the company (me) during the Term where a day......... etc
They have changed wording this year slightly, but still maintain when asked, that its a 150 day guaranteed contract. Should i be suspicious, or is it jargon ?Question posted on 24-01-2012 16:38
My daughter is a student entering into a joint tenancy agreement with 2 other students. Under the terms of the tenancy each tenants rent is specified equally, however the landlord has made it clear they are all 'jointly and severally' liable for the rent, meaning (as I understand) any one of them could be chased for the rent if someone fails to pay. If this ever happened, and my daughter ended up having to pay someone else's share of the rent, is it easy for her (us) to pursue the defaulting tenant(s) for the shortfall, or do we need a separate agreement between the tenants precisely spelling out each tenants obligations and the recovery process should someone default on their share of the rent (or other obligations under the terms of the tenancy)?Question posted on 23-01-2012 15:00
